Terms of Service

These Terms govern your use of the PostureAI service. By creating an account or using the service, you agree to them. If you do not agree, do not use the service.
1. The service
PostureAI provides software that captures and analyzes postural imagery to generate reports for clinical use. It is a decision support tool, not a diagnostic device, and not a replacement for clinical judgment.
2. Accounts
You are responsible for credentials issued for your practice, including those of your staff. Keep passwords confidential, enable multi-factor authentication, and notify us immediately of suspected unauthorized access.
3. Acceptable use
- Do not upload data for people who have not provided appropriate consent under applicable law.
- Do not reverse-engineer, resell, or sublicense the service without written permission.
- Do not attempt to bypass security controls, access other customers' data, or use the service for unlawful purposes.
4. Fees and billing
Subscription fees are billed in advance (monthly or annually). All fees are non-refundable except where required by law. We will provide at least 30 days' notice before a price change takes effect.
5. Data
You retain ownership of the data you upload. You grant PostureAI a limited license to process that data solely to deliver the service and its contracted features. We do not sell, rent, or share your data for advertising.
6. HIPAA
If you are a Covered Entity under HIPAA, our standard Business Associate Agreement (BAA) applies and is incorporated into these Terms by reference.
7. Service availability
We target 99.9% monthly uptime for production services. Scheduled maintenance is announced in advance and performed during low-traffic windows. We are not liable for outages caused by third-party providers, force majeure, or customer-side connectivity.
8. Warranties and disclaimers
The service is provided “as is”. We disclaim all warranties not expressly stated in these Terms, including fitness for a particular purpose. Nothing in these Terms limits liabilities that cannot be limited under applicable law.
9. Limitation of liability
To the maximum extent permitted by law, PostureAI's aggregate liability under these Terms is limited to the amount you paid in the twelve months preceding the event giving rise to the claim.
10. Termination
Either party may terminate this agreement at any time. On termination, we provide an export of your data for 30 days. After that, data is deleted per our Privacy Policy.
11. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.
